GREENVILLE, SC – A woman convicted of falsely claiming her daughter had cancer to solicit funds from the community and not reporting her grandfather’s death so she could cash his social security checks has pled guilty to one count of social security fraud in federal court.
Alicia Kelly was convicted of abuse or neglect of a vulnerable adult, destruction or desecration of human remains, child abuse or neglect, three counts of contributing to the delinquency of a minor, and two counts of swindling. Judge T.L. Hughston sentenced Kelly to ten years, suspended to three years followed by two years of probation, on March 7, 2012. Kelly was given credit for time served, which began February 4, 2011.
Kelly was released from state prison on October 1, 2012, after serving just one year, seven months and 25 days of her sentence. She was turned over to Saluda County officials at that time to stand trial for three fraudulent check charges. She pled guilty to those charges and received a sentence of 30 days in jail.
After serving 30 days in the Saluda County Detention Center, Kelly was picked up by U.S. Marshals and transferred to an undisclosed location. Kelly pled guilty to one charge of embezzling greater than $1,000 from the Social Security Administration and is currently awaiting sentencing on that charge.
According to federal officials, Kelly will appear at a sentencing hearing once her presentencing report is completed. Those reports typically take between two and three months to generate and include the person’s life history as well as facts and allegations concerning the specific charges. Federal officials would not release the exact amount of money which they allege Kelly stole until the presentencing report is complete.
Sources close to the family of Therol Lunney have told GwdToday that Kelly may have cashed as many as 18 monthly checks of about $1,200 each. Kelly could face a sentence of up to five years in a federal prison and be fined up to $250,000 for fraudulently cashing the checks.
No date has been set for Kelly’s sentencing hearing. She is currently being held at an undisclosed location.
